Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) are a legal agreement between you and Sheboftek (“we,” “our,” or “us”), the developer of the Daily Hype mobile application and the website at getdailyhype.app (collectively, the “Service”).

By creating an account, downloading, installing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms supplement — and do not replace — Apple’s Licensed Application End User License Agreement (“Apple EULA”), which also governs your use of the App as downloaded from the App Store. In the event of a conflict between these Terms and the Apple EULA, the Apple EULA shall prevail to the extent of the conflict.

2. Eligibility

You must be at least 17 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

This age requirement reflects the App’s 17+ App Store rating and is consistent with the terms of the third-party AI service (Google Gemini API) used to generate content within the App.

3. Description of Service

Daily Hype is an AI-powered motivational application that delivers personalized short-form motivational content (“Drops”) based on topics and voice tones you select. The Service includes:

  • Daily Drops — AI-generated motivational messages with micro-action prompts
  • Behavioral Packs — structured multi-day programs (7-day journeys and 3-day sprints) designed to build specific habits
  • Progress Tracking — streaks, daily win logging, and calendar-based history
  • Customization — 75+ topics across 10 categories and 5 voice tones
  • Sharing — share cards for social media and home screen widgets

Features may be added, modified, or removed over time. We will make reasonable efforts to notify you of material changes.

4. Account Registration

To use the Service, you must create an account using one of the supported sign-in methods:

  • Apple Sign-In — using your Apple ID (you may choose to hide your email)
  • Google Sign-In — using your Google account
  • Email — using your email address and a password

You agree to:

  • Provide accurate information during registration
  • Maintain the security of your account credentials
  • Notify us promptly if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

You may not create more than one account per person.

5. Subscriptions and Payments

5.1 Free Trial

New subscribers are eligible for a 7-day free trial that provides full access to all premium features. The trial begins when you confirm your subscription in the App Store. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

5.2 Subscription Plans

Daily Hype offers two subscription plans:

  • Monthly — billed every month
  • Annual — billed once per year

Prices vary by country and currency, as determined by Apple’s App Store pricing tiers for your region. The exact price is displayed in the App and on the App Store confirmation screen before you subscribe. All prices include applicable taxes where required by law.

5.3 Auto-Renewal

All subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period. Upon renewal, your Apple ID will be charged the same amount as the current period. The renewal date is based on the date of the original purchase.

5.4 Managing and Cancelling

You can manage or cancel your subscription at any time through your device:

  • Open Settings on your iPhone or iPad
  • Tap your name (Apple ID) at the top
  • Tap Subscriptions
  • Select Daily Hype and tap Cancel Subscription

After cancellation, you retain access to premium features until the end of the current billing period. No partial refunds are given for unused time within a billing period.

5.5 Refunds

All payments are processed by Apple. Refund requests must be submitted to Apple directly through their Report a Problem page. We do not process payments or issue refunds directly.

5.6 Price Changes

We may change subscription prices from time to time. If we increase the price of your current plan, Apple will notify you in advance and request your consent before the new price applies. If you do not consent, your subscription will not renew at the new price.

6. AI-Generated Content

6.1 Nature of AI Content

Drops and other motivational content in the App are generated using artificial intelligence (powered by the Google Gemini API). AI-generated content is created algorithmically based on your selected topics and tone preferences. It is intended for motivational and informational purposes only.

6.2 Limitations and Disclaimers

You acknowledge and agree that AI-generated content:

  • Is not a substitute for professional medical, psychological, psychiatric, therapeutic, financial, or legal advice
  • May occasionally contain inaccuracies, irrelevant suggestions, or statements that are not appropriate for your specific circumstances
  • Should not be the sole basis for decisions that affect your health, finances, relationships, or legal matters
  • May vary in quality and relevance from day to day

6.3 Crisis Situations

Daily Hype is not a crisis intervention tool. If you are experiencing a mental health emergency, suicidal thoughts, or any situation requiring immediate help, please contact a qualified professional or emergency services in your area:

  • Emergency services: Call 911 (US), 112 (EU), or your local emergency number
  • Crisis Text Line: Text HOME to 741741 (US)
  • Suicide & Crisis Lifeline: Call or text 988 (US)

6.4 Content Availability

AI-generated content requires an active internet connection. If the AI service is temporarily unavailable, the App may display pre-written fallback content or previously cached drops. We do not guarantee uninterrupted availability of AI content generation.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You may not:

  • Use the Service for any illegal, harmful, or fraudulent activity
  • Attempt to reverse-engineer, decompile, disassemble, or extract the source code of the App
  • Interfere with, disrupt, or place unreasonable load on the Service’s infrastructure
  • Create multiple accounts to exploit free trials or circumvent restrictions
  • Use automated tools, bots, or scripts to interact with the Service
  • Redistribute, resell, sublicense, or commercially exploit App content without written permission
  • Impersonate another person or misrepresent your affiliation with any entity
  • Circumvent, disable, or otherwise interfere with any security-related features of the Service

Violation of these rules may result in immediate suspension or termination of your account without notice.

8. Intellectual Property

8.1 Our Intellectual Property

The Service — including its design, code, branding, graphics, animations, text content, and AI prompt templates — is owned by Sheboftek and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

8.2 Your License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for your personal, non-commercial purposes.

8.3 Share Cards

The App allows you to generate share cards containing motivational content. You may share these cards on social media, messaging platforms, and personal channels for non-commercial purposes, provided that you do not remove or obscure the Daily Hype branding on the card.

9. User Content

“User Content” means any content you create or input within the Service, including daily win entries, notes, and ratings.

  • You own your User Content. We do not claim ownership of anything you create
  • By using the Service, you grant us a limited, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service
  • We will not share your User Content with third parties except as described in our Privacy Policy
  • If you delete your account, your User Content will be deleted in accordance with our data deletion policy (see Section 11)

10. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes what information we collect, how we use it, who we share it with, and your rights regarding your data. Please read it carefully.

11. Account Deletion and Termination

11.1 Deletion by You

You may delete your account at any time using either method:

  • Inside the App: Go to the Profile tab and tap Delete Account
  • By email: Send a request to contact@getdailyhype.app from the email address associated with your account

When you delete your account, all your personal data, usage history, and User Content will be permanently deleted within 30 days. Data managed by third parties (Apple purchase history, Apple/Google account credentials) is not affected.

Important: Deleting your account does not automatically cancel an active subscription. You must cancel your subscription separately through your device settings (see Section 5.4) to avoid further charges.

11.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms or any applicable law
  • Your use of the Service poses a security risk or may harm other users
  • We are required to do so by law or legal process

If we terminate your account due to your breach of these Terms, you are not entitled to a refund for any remaining subscription period. You may contact Apple for refund requests.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY AI-GENERATED CONTENT. YOU USE SUCH CONTENT AT YOUR OWN RISK.
  • WE MAKE NO REPRESENTATIONS REGARDING THE RESULTS YOU MAY OBTAIN FROM USING THE SERVICE. THE SERVICE IS NOT A GUARANTEE OF PERSONAL IMPROVEMENT, BEHAVIORAL CHANGE, OR ANY SPECIFIC OUTCOME.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply only to the extent permitted by law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL SHEBOFTEK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR PERSONAL INJURY.
  • OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

These limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Sheboftek and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you create or share through the Service

15. Third-Party Services and Links

The Service may contain links to or integrate with third-party services (including Apple Sign-In, Google Sign-In, Apple’s App Store, and Google’s Gemini API). These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, policies, or practices of any third-party service.

Your interactions with third-party services are solely between you and the relevant third party.

16. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will:

  • Update the “Last updated” date at the top of this page
  • Post the revised Terms in the App and on our website
  • Where required by law, provide advance notice via email or an in-app notification

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law provisions.

If a dispute arises between you and Sheboftek, we encourage you to first contact us at contact@getdailyhype.app to attempt to resolve the matter informally. If we cannot resolve the dispute within 30 days, either party may pursue resolution through the courts located in the State of California.

Nothing in these Terms affects any mandatory consumer protection rights that apply to you under the laws of your country of residence.

18. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy and the Apple EULA, constitute the entire agreement between you and Sheboftek regarding the Service
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect
  • Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision
  • Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction
  • No Third-Party Beneficiaries: These Terms do not confer any rights on any third party, except that Apple and its subsidiaries are third-party beneficiaries of these Terms as the provider of the App Store from which the App is downloaded
